Terms & Conditions
All sales are made under full compliance with the laws of New Zealand including:
Fair Trading Act
Sale of Goods Act
Consumer Guarantees Act
PRICE AND TERMS OF PAYMENT
All ATL Satellite prices are in New Zealand dollars and include GST.
1. ATL Satellite prices are subject to alteration without notice and the price payable by the customer for the goods/services ordered shall be the price ruling at the date the goods/services are dispatched for delivery to the customer.
2. If the goods/services are sent or performed overseas, the price and other moneys due from the customer shall be paid in New Zealand currency unless expressly agreed to by ATL Satellite in writing.
3. Payment for goods/services shall be made in full without any deduction or set-off
4. ATL Satellite stock all items advertised, however we reserve the right not to accept any orders or to cancel confirmed orders for products that are no longer available or are out of stock. In such am event we will inform you by e-mail and any payments will be refunded.
SHIPPING.
Unless specified, your order will be shipped via the most economical carrier which is typically New Zealand Couriers in New Zealand. Shipping costs will be added to your order.
Delivery:
Please note all delivery times quoted below commence from when your payment has been received.
The shipping times below are realistic targets that we usually achieve.
Delivery times - New Zealand
We send orders via New Zealand Couriers tracked courier service. Our target is to dispatch your order the same day
from our Auckland warehouse. Expect delivery within 1-3 working days from the time you place your order.
Delivery Costs
We have a shipping calculator built into our shopping cart.
Please note - make sure that you provide a shipping address that is attended.
If a courier is used and cannot deliver, and needs to bring the ordered item back
to their depot, you may be charged for the re-delivery.
INTERNATIONAL CUSTOMS AND IMPORT DUTIES INFORMATION.
Any customs duties, brokerage fees and import taxes that are levied by the shipper or importing country are the responsibility of the customer.
PROPERTY AND RISK.
Risk (including insurance responsibility) shall pass to the customer on collection of the goods/services by the customer or on delivery by ATL Satellite or agent acting on behalf of ATL Satellite to a carrier for delivery to the customer.
Ownership of all goods/services sold by ATL Satellite is retained by ATL Satellite until full payment is received for all amounts owing in respect of all goods/services supplied. This provision is designed to protect ATL Satellite in the event of the bankruptcy, receivership or liquidation of the customer, a seizure of goods/services by a creditor of the customer or default in payment. Such events and the filing of legal proceedings seeking any such event are subsequently referred to as ‘the said events’.
Until such payment is made the customer shall be only a fiduciary owner of the goods/services and the customer agrees to:
1. Enable the goods/services to be readily identifiable as the property of ATL Satellite.
2. Maintain the goods/services so supplied in good order and condition and to return the goods/services immediately if called upon to do so by ATL Satellite.
In the event of default in payment on the due date, for which time is strictly of the essence, or in any of the other said events the customer shall at the request of ATL Satellite hand to ATL Satellite the said goods/services or such of the goods/services as had not been sold AND ATL Satellite is authorised by the customer to enter any premises on which the goods/services may be located and to recover the same
The customer hereby agrees to meet all costs of, and any incidentals in the recovery of the said goods/services as well as any shortfalls between the amount owing and the value of the goods/services recovered.
RETURNS
Goods Supplied in accordance with the customer’s order can only be returned with the express approval of ATL Satellite, or as otherwise required by law.
In order to return goods the customer is to submit in writing within 10 days from the date of supply a request to return the goods.
Where the goods are accepted for credit they are to be returned at the customers expense to ATL Satellites Warehouse.
ATL Satellite reserves the right to apply a 20% restocking fee on any Credit.
PRIVACY
Your privacy is important to us and we will not do anything to violate your trust. We treat customer information as strictly confidential and so it is never revealed to third parties.
SECURITY:
For your security we use Paystation to provide our credit card merchant services.
We do not hold any of your credit card details on our servers. All credit card is processed in a secure and PCI compliant by Paystation.
For transmitting sensitive information, we use the Secure Socket Layer (SSL) protocol so Credit Card Details are not exposed to us.
DISCLAIMER
Product descriptions, typographic, pricing and photographic errors are unintentional and subject to correction. We regret, but are not liable for, incorrect photos or typographical errors. We reserve the right to refuse any order for any reason.
LAW
The contract and these conditions of sale shall be governed by New Zealand Law and the New Zealand Courts shall have exclusive jurisdiction in connection herewith.
DISPUTES
In the event that any part of an invoice is disputed, the amount not under question shall be paid promptly according to applicable payment terms. Any claims or disputes arising hereunder shall be subject to arbitration in accordance with the Arbitration Act (1980) of New Zealand.
WARRANTY AND REPAIRS
All products sold by ATL Satellite are covered by a Manufacturer’s Warranty, should you have a warranty failure then you must submit a return for warranty replacement to craig@atlcommercial.co.nz, ATL Satellite will issue a Return number and process the claim as quickly as possible.
Iridium Pre-paid Airtime Terms & Conditions:
VALIDITY:
Validity starts at time of activation of the Pre-paid SIM card.
If you renew the Prepaid SIM card before the expiration date, any unused minutes will roll over to the next annum.
Adding minutes to a plan extends expiration date according to original plan
If the SIM card expires you lose any unused minutes but have 90 days to add minutes before the SIM card becomes null and void.
Maximum extension of Prepaid Account access is 2 years from the last recharge.
Reactivation of an expired SIM can be done at a cost of US$ 225.00
STANDARD PLANS:
This date can be extended by purchasing a prepaid voucher or 30 day extension (excluding the 50 minute voucher).
Please request a minimum of 48 hours before your SIM expiry date:
If the expiry date is not extended then your SIM Card will expire and become invalid. Any minutes remaining will be lost and your SIM will enter a 90 day grace period in which you may reactivate the SIM by adding a new voucher, however the original balance will be lost and will not be added to the new balance. After this 90 day period has ended the SIM will automatically deactivate meaning that you will need to purchase a new SIM Card and pre-paid voucher.

Data Transmission Use and Dropped Calls:
Due to the technical nature of voice and data setups and the inherent sophistication of voice and data transmission through a variety of satellites, systems, and networks, ATL Commercial Ltd makes no representation as to the success of such calls through the system. Customer agrees that all voice and data call attempts regardless of ultimate successful transmission and termination will be paid for and no credits will be given in the event of disputes of this nature. Along with potential incorrect use (i.e., next to a building / obstruction), the Inmarsat system (a geostationary satellite constellation) has inherent flaws and anomalies that can create dropped calls of either voice or data nature. Dropped calls will not be credited.
Limitations of Liability:
The satellite services provided by ATL Commercial Ltd may be temporarily interrupted, delayed or otherwise limited and are not available everywhere in the world. ATL Commercial Ltd makes no representation that it can provide uninterrupted service. Furthermore, ATL Commercial Ltd shall have no liability or credit due for interrupted service unless caused by the gross negligence of ATL Commercial Ltd. ATL Commercial Ltd shall not be liable for acts or omissions of other carriers, equipment failures or modifications, acts of God, strikes, government actions, or other causes beyond our reasonable control. ATL COMMERCIAL LTD MAKES NO WARRANTIES WITH RESPECT TO THE SERVICE OF ANY KIND WHATSOEVER, EXPRESSED OR IMPLIED, EXCEPT AS SPECIFICALLY PROVIDED IN THIS AGREEMENT. THE IMPLIED WARRANTEIS OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE ARE HEREBY DISCLAIMED AND EXCLUDED. ATL COMMERCIAL LTD SHALL NOT BE LIABLE TO ITS DISTRIBUTOR OR CUSTOMER OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
Subscriber Terminals and Equipment:
Unless provided otherwise, ATL Commercial Ltd is not responsible for the installation, operation, quality of transmission, or maintenance of Customer equipment. If Customer’s equipment is stolen, Customer is responsible for all charges as agreed upon in this Agreement
